Welcome to SalesLead.ai, a product of Seacoast Consulting Group LLC (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, products, and services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.
1. Eligibility

SalesLead.ai provides appointment scheduling and data validation services leveraging voice AI, SMS, Email, and a variety of other technologies. Details of the Services may vary based on agreements executed with individual clients.
3. Privacy and Data Usage
3.1 Personal Information

3.2 Consent to Data Processing
You consent to the collection, use, processing, and transfer of your PII, including voice recordings, SMS transcripts, and other data necessary to provide the Services. You acknowledge and agree that your PII may be shared with third-party service providers and affiliates for purposes consistent with providing the Services.
3.3 Compliance with Data Protection Laws
SalesLead.ai complies with applicable laws governing the collection, use, and storage of PII, including but not limited to the California Consumer Privacy Act (CCPA), the General Data Protection Regulation (GDPR), and other applicable data protection laws. 4. Compliance with Communications Laws

You agree that the use of SalesLead.ai’s Services complies with the TCPA, including obtaining all required prior express consent before sending automated messages or making automated calls to consumers. You are responsible for ensuring that all communications comply with applicable TCPA requirements.
4.2 Do Not Call (DNC) Registry Compliance
SalesLead.ai respects the National Do Not Call Registry and other state-specific DNC laws. By using the Services, you agree to ensure that any communication is not made to individuals who have registered on the DNC list unless expressly permitted by law.
4.3 CAN-SPAM Act Compliance
If you use our Services to send commercial emails, you must comply with the CAN-SPAM Act, including but not limited to including an opt-out mechanism, accurate sender information, and a valid physical address in your communications.
5. Artificial Intelligence Usage
5.1 AI-Driven Services
SalesLead.ai leverages artificial intelligence (AI) to provide Services, including voice AI and automated SMS systems. You acknowledge and agree that AI tools may analyze user interactions, process data, and generate automated communications.
5.2 Transparency and Accuracy
While our AI is designed to provide accurate and efficient Services, you acknowledge that errors or inaccuracies may occur. SalesLead.ai disclaims liability for decisions made based on AI-generated outputs.
5.3 AI Ethics and Accountability
SalesLead.ai is committed to ethical AI practices, including minimizing bias and ensuring compliance with all applicable regulations regarding AI usage.
6. User Responsibilities
6.1 Accuracy of Information
You are responsible for providing accurate and complete information when using the Services. SalesLead.ai is not liable for any issues arising from incorrect or incomplete information provided by you.
6.2 Prohibited Uses
You agree not to:
Use the Services for any unlawful purpose;
Interfere with or disrupt the operation of the Services;
Upload or transmit malicious code or harmful materials;
Attempt to reverse-engineer or decompile any part of the Service;
Provide false or fictitious information;
Represent yourself as a person or entity other than yourself.
7. Payment Terms
7.1 Billing and Invoicing
Invoices will be issued according to the terms specified in your client agreement. Payments are due within the time frame outlined in the individual agreements.
8. Intellectual Property
8.1 Ownership
SalesLead.ai retains all intellectual property rights in and to the Services, including but not limited to software, designs, trademarks, and content.
8.2 License
SalesLead.ai grants you a limited, non-exclusive, non-transferable license to use the Services solely for your internal business purposes.
9. Limitation of Liability
To the fullest extent permitted by law, SalesLead.ai shall not be liable for:
Any indirect, incidental, special, or consequential damages; Loss of profits, revenue, or data arising from your use of the Services;
Any damages exceeding the amount you have paid to SalesLead.ai in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless SalesLead.ai, its affiliates, and their officers, directors, employees, and agents from and against any claims, damages, liabilities, and expenses arising out of your use of the Services or breach of these Terms.
11. Termination
11.1 Termination by You
You may terminate your use of the Services by providing 30 days' written notice to SalesLead.ai.
11.2 Termination by Us
We may suspend or terminate your access to the Services at our sole discretion if you violate these Terms or engage in conduct harmful to the Services or other users.
12. Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to its conflict of laws principles.
12.2 Arbitration
Any disputes arising under these Terms shall be resolved through binding arbitration conducted by the American Arbitration Association in accordance with its Commercial Arbitration Rules.
13. Changes to Terms
We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting. Continued use of the Services after changes constitutes acceptance of the updated Terms.
